Policies 

 

Sisters in Motion is the company responsible for providing to You the services described in this Agreement. Purchases made at SIM’s San Francisco studio location are only applicable for services rendered at said location and are non-transferrable to any other studio or licensed S Factor studio. 

 

A.  Membership Program Agreements: 

•     All sales on Down Payments, Paid in Full Memberships, Parties, Virtual Courses, Events and Retreats are final. No exceptions.  No cancelations before 90 days. Studio Credit may be available in some cases. Thank you for understanding.

 •     All Programs and Memberships will be paid for via SIM’s automated billing program which will be stored and protected through the MindBody software (or such other software selected by SIM from time to time). You will be required to keep your on-file Credit Card information up-to-date.

•     All memberships will be billed every 4 weeks from the start date of the membership, unless otherwise noted in this Agreement. 

•     Any Programs that are Paid in Full are non-refundable and cannot be canceled. 

•     Financed options require a 90 day minimum before cancellation is permitted. During this 90 days the student must be active and not on hold. Any time spent on hold will not be counted towards the 90 days.

•     After 90 days, all financed Programs require 30 days’ prior written notice for any cancelation during which time students are permitted to attend SIM Classes and any charges schedule to be auto-billed will still be charged during that 30 days.  Any 30 days’ prior written cancellation notice must be emailed directly to kerryanne@sistersinmotionsf.com (or any other email address established by SIM for notices from time to time). The 30 days starts upon SIM’s receipt of written notice in accordance herein.

•     Any Program or Membership cancelations that are requested prior to the then effective end date of the Program or Membership will be subject to a $499 early cancellation fee.

•     Any Program or Membership cancelations that are requested due to moving 25 miles or more away from the Sisters in Motion Studio location will require proof of new address in order for early cancellation fee to be waived.

•     All down payments and paid-in-full payments for Programs and Memberships are non-refundable and non-transferable unless cancelled more than Fourteen (14) days prior to the start date for the Program or Membership.

B.  Renewing Your Program: 

•     After the first year of membership, all 1 year financed membership options (Silver, Gold & Platinum) will continue on as a month to month membership with no annual commitment and will continue to be billed every 4 weeks until 30 days notice to cancel is received or until SIM discontinues the membership for any reason.

•     Students who renew the terms of their paid in full Program or Membership, as applicable, by their expiration date, will be offered the full price of the paid in full membership type they they are renewing.  A loyalty discount may be offered but is not guaranteed. Students will also continue to receive their current benefits and will not be subject to new terms.

•     Students who do not renew their terms of their Program or Membership, as applicable, by their expiration, will be subject to all current studio pricing and benefits available at time of late renewal.

•     All virtual memberships will be charged every 4 weeks unless a 30 day cancellation notice is received by email after which any charges for the following 30 days of that request will still be charged to the account.

 

C.  Journey Classes:

•     For any Program, Membership or Agreements that include a Home SIM Class hosted by SIM, Sisters in Motion agrees to hold a spot for you in the Home Class as agreed upon between You and SIM in writing. Should your account become delinquent of 30 or more days, you will lose Your spot in Your pre-scheduled Home SIM Class until payment is received to bring Your account fully up-to-date and in good standing per the billing cycle as defined in this Agreement.

•     Journey SIM Classes hosted by SIM may be cancelled at Sisters in Motion sole discretion, for any reason. In case of a Journey SIM Class cancellation by SIM, Sisters in Motion will credit any payment made for such canceled Journey SIM Class to another comparably priced SIM Class.

•     Unless otherwise notified by an SIM staff member, the use of recording devices in any SIM Class or any other SIM Activity is strictly prohibited.

•     The cancellation of a Home SIM Class by Sisters in Motion is not grounds, nor a permissible reason, for Agreement cancellation. 

 

D.  Single or Individual SIM Classes and/or SIM Activities:  

•     All individual SIM Classes and/or SIM Activities (whether S Factor or otherwise) must be paid in full at least 15 minutes before the start time of such SIM Class and/or SIM Activity in order to attend. Payments must be made by credit card, Rewards card or via Your student profile, unless otherwise approved by SIM.

•     All payments for individual in-person SIM Classes are non-refundable and non-transferable unless cancelled by You more than seven (7) days prior to the start date of the individual in-person SIM Class. Any in-person SIM Class cancellations made by You less than 7 days in advance but at least 4 hours before the start of the SIM Class will receive a credit to Your student profile in the amount of cancelled SIM class. 

•     If you cancel your SIM Class less than four (4) hours prior to the start of Your reserved SIM Class for any reason, any payments will be forfeited and non-refundable. 

•     All in-person SIM Classes may be cancelled at Sisters in Motion’s sole discretion for any reason. In case of an SIM Class cancellation by SIM, Sisters in Motion will credit any payment made for such cancelled class to another comparably priced class. 

 

E.  Private Lessons:

•     Full payment is required to book a private lesson.

•     Seventy-two (72) hours advance notice by You is required to reschedule Your private lesson.  Any and all rescheduling will be at the sole discretion of Sisters in Motion, LLC and subject to teacher and studio availability.

•     All payments for private lessons are non-refundable and non-transferable unless canceled more than Fourteen (14) days prior to the private lesson date. 

•     Private lessons may be cancelled at Sisters in Motion, LLC’s sole discretion for any reason. In case of a private lesson cancellation by SIM, Sisters in Motion will credit any payment made for any such canceled private lesson to a new date for a private lesson subject to availability.

•     Private packages are non-refundable.

 

F.   Private Parties: 

•     Fifty percent (50%) non-refundable deposit is required to book a private party.  The remaining fifty percent (50%) payment is required no later than seven (7) days prior to the private party date.

•     To cancel and receive a credit to your account for your fifty percent (50%) deposit, SIM must receive your written notice of cancellation (addressed to kerryanne@sistersinmotionsf.com or any other email address established by SIM for notices from time to time) at least fourteen (14) days before the date of the private party.  Any cancellation, partial or otherwise, received less than fourteen (14) days before the date of party for any reason will not be credited and will not be refunded. 

•     If you need to reschedule your private party, SIM must receive written notice of reschedule at least seven (7) days before the date of Your private party; provided, that any and all rescheduling will be subject to studio availability and the rescheduled date must be on a date within 45 days of the then existing private party date.

•     Private parties may be cancelled at Sisters in Motion’s sole discretion for any reason.  In case of a private party cancellation by SIM, Sisters in Motion will credit any payment made for any such canceled private party to a new date for a private party subject to availability.

 

G. Late Policy: 

•     There is a ten (10) minute grace period for late arrivals after which time, You will not be admitted into the SIM Class or SIM Activity. Any students not admitted into the SIM Class or SIM Activity due to late arrival will not be granted a make-up or a refund for the SIM Class or SIM Activity.

•     If You know you are going to be late to Your SIM Class or SIM Activity, please call or text the studio at 415.440.6420, enter quietly upon arrival, and be mindful to not disrupt Your fellow students and instructor. 

 

H.  Signing Out of Classes

•     Students are able to sign out of an SIM Class or SIM Activity from their student profile at sfactor.com, the S Factor San Francisco App or by calling or texting the studio at 415.440.6420. Emails are not a valid form of signing out.

•     For Single or Individual SIM Classes, You will need to sign out more than 24 hours in advance to receive a credit toward a comparably priced SIM Class. Sign-outs for Single or Individual SIM Classes less than 24 hours before the SIM Class start time are not eligible for a credit. As long as Your first attempt to sign out falls within the grace period, You are eligible to receive a SIM Class credit.

•     Unused SIM Classes or SIM Activities do not roll-over.   

•     Please make sure You sign out of the SIM Class at least 4 hours in advance of Your SIM Class start-time in order to allow another student to fill Your spot. The sign-out policy for is an act of good-faith and thoughtfulness for Your fellow students. 

•     There will be a “Late Sign Out Fee” applied to Your account if You sign out less than 4 hours before the start of an SIM Class or do not sign out of an SIM class and do not show up for any SIM Class You are signed in to.  Please refer to the SIM website for this fee as it applies to in-person SIM Classes and online SIM Classes.

•     There will be no monetary refunds for missed SIM Classes or SIM Activities. No exceptions.

 

I.     Holds & Medical Rollovers

  • Should You become injured or ill to the extent that participation in a SIM class is not advisable by Your physician, you may apply for a Medical Hold. A medical hold will pause your account and any and any membership payments for up to 2 months, after the initial hold payment is taken. See hold process below for further information.

  • If your physician does not permit you to resume SIM Classes after the initial 2 month period, please notify us as soon as possible in order to extend any credits. Failure to notify SIM within 6 hours after missing an SIM Class will forfeit the possibility of a Medical Roll Over. If you need an extension past the 2 months due to a medical reason, you will be asked to submit a doctors note.

  • Holds for pregnancies will be the exception – we will hold up to two months after the due date.

  • Students may put their account on a non-medical hold once every 12 months provided they are going to be gone for at least one billing period (28 days), and may be on hold for up to 2 months.

  • All holds and connected credits will expire 2 months from the initial hold date, unless another agreement is reached with Sisters in Motion in writing.

  • Time on hold does not count towards fulfilling Your contract term and will need to be made up on the tail end of contract/membership term until all time/payments have been fulfilled.

  • If You choose to put your account on hold, your spot in Your Home Class will be forfeited.

  • For students on a financed membership, Sisters in Motion will take the payment for the first month of hold or MRO which is required to initiate all MRO’s and holds. Provided you return prior to your hold’s expiration (2 months from the start date), you will receive this payment as a credit upon your first month back. Your regular billing will proceed 4 weeks after your return. For students on a Paid in Full membership, you will have the time on hold tacked on to the end of your membership.

  • If a student doesn’t return from hold before her 2 months are up, you will receive a notification from the studio that we will be activating your membership on the date that is 2 months from you hold start date. If you are on a financed option, payments will automatically resume as usual. If on a Paid in Full, your membership will activate after those 2 months. It is up to you to schedule your new home class.

  • If for any reason we are unable to take payments upon reactivation, the membership will immediately be cancelled. No credit will be given for the hold payment as it will applied to your 30 days notice. Should you return at a later date, you will be subject to the current pricing and membership options, and will not be grandfathered into your old membership options.

  • Any request for an MRO or hold may be granted or denied at SIM’s sole discretion

J.   Membership Cancellation Policy:

•     Prepaid Memberships or Programs are non-cancelable and non-refundable.

•     Financed Programs may not be cancelled for the first 90 days of active membership only after which will require 30 days written notice to cancel. Any fees due during that space of 30 days will be charged per usual. 

•     Any cancellations prior the end of the initial contract and before it turns into a Month-to-Month Agreement will be charged a $499 early cancellation fee, on top of any charges set to go through during the time period from written notice to 30 days after. All Agreements, whether on month-to-month status or not, require 30 days written notice of cancellation. All fees and charges will continue to accrue and be due and payable during the thirty (30) day notice period (i.e., prior to the effective cancellation date).

•     Any cancellations of Virtual Membership agreements require 30 days written notice of cancellation. Students will be allowed to attend class during this period of 30 days. All fees and charges will continue to accrue and be due and payable during the 30 day notice period (i.e. prior to the effective cancellation date). There is no early cancellation fee due for Virtual Membership cancellations.

•     See “Program Agreements” section for any additional policies.

 

K. Safety:  If You appear intoxicated, fail to follow SIM’s safety requirements and precautions (including without limitation, health and safety requirements and protocols established by the state or local authorities) or are otherwise disruptive to the conduct of an SIM Class or other SIM Activity, You may, at the sole discretion of Sisters in Motion, be asked not to participate, in which event You will forfeit any payments made by You for that SIM Class or other SIM Activity and shall not be entitled to receive a refund or credit. 

 

L. Arrival and Departure Times:  Please arrive a few minutes prior to Your SIM Class or SIM Activity scheduled start time.  You may depart at any time once the SIM Class or SIM Activity has started, but You cannot makeup the SIM Class or SIM Activity time should You choose to depart early. 

 

K.  Schedule Changes:  All class times, schedules and teachers are subject to change at Sisters in Motion’s discretion.

 

L. SIM Event or Performance Participation:  You hereby agree that if You attend any event of SIM Class or SIM Activity (excluding Journey SIM Classes), You agree to being photographed, filmed or taped and authorize the use of Your image by SIM for marketing purposes without compensation.

 

M. Additional Terms for Online Classes:

·       For Programs or Memberships that include online SIM Classes, Sisters in Motion agrees to hold a spot for you in the online SIM Class as agreed upon between You and SIM. Should your account become delinquent by 30 or more days for any reason, you will lose Your ability to sign into online SIM Classes without further notice, until full payment is received by SIM to bring Your account balance fully up-to-date and in good standing per the billing cycle as defined in this Agreement.

·       Every online SIM Class requires a minimum of three (3) students to be signed in twelve (12) hours in advance of the SIM Class in order for the SIM Class to be green-lit. Any online SIM Class with less than three (3) students signed in twelve (12) hours before the start time of the SIM Class is subject to cancellation by SIM, in its sole discretion.  Please be advised that a no-show/late sign-out fee will apply if you timely sign up for an SIM Class but fail to appear or join the SIM Class timely.

·       All online SIM Classes require 2  hours’ notice for students to sign out. Otherwise they may be subject to a late cancellation fee.

·       All students, including You, are responsible for updating all email and Spotify accounts in order to participate in the online SIM Class being offered.

·       Any online SIM Class may be cancelled at Sisters in Motion’s sole discretion, for any reason. In case of an online SIM Class cancellation by Sisters in Motion for which an online/virtual member has paid a per class fee, SIM will credit any payment made previously for such canceled SIM Class to another comparably priced SIM Class.  

·       Unless otherwise notified by an authorized SIM staff member in writing, the use of recording devices in or of any online SIM Class is strictly prohibited. Violation of this policy shall result in immediate termination of Student’s online access.

·       The cancellation of an online SIM Class by Sisters in Motion is not grounds, nor a permissible reason, for Agreement cancellation. 

·       Unless otherwise agreed to in writing in advance by an authorized representative of SIM, online SIM Classes provided by SIM and/or its instructors are available only to current SIM members/program holders.  Violation of this policy shall result in immediate termination of Student’s online access.

·       There will be no monetary refunds for missed SIM Classes. No exceptions.

·       Online SIM Classes are not available to students on hold.  

·       Payments are not transferrable for any reason.

·       SIM Class packages with a set date of expiration will not be extended beyond their expiration date for any reason including but not limited to injury or illness.

N. Schedule Changes:  All SIM Class and SIM Activity times, schedules and teachers are subject to change at Sisters in Motion’s sole discretion.

•     All accounts will automatically go to a month-to-month status after the minimum term is met and will continue to be billed $220 every 4 weeks until cancellation is received in writing with 30 days’ written notice in accordance with this . All terms and policies regarding make-ups, sign-outs, SIM Classes, other SIM Activities and fees will remain intact and continue to apply in full force and effect in case of a month-to-month status, however any cancellations will no longer be charged an early cancellation fee once original term of the membership is met.

•     All down payments and paid-in-full payments for Programs and Memberships are non-refundable and non-transferable unless cancelled more than Fourteen (14) days prior to the start date for the Program or Membership.  

 

B.  Renewing Your Program: 

•     Students who renew the terms of their Program or Membership, as applicable, within seven (7) days of their expiration date will be grandfathered into their current pricing and benefits and will not be subject to new terms. 

•     Students who do not renew their terms of their Program or Membership, as applicable, within 7 days of expiration, will be subject to all current pricing and benefits available at time of late renewal.

•     All new or renewed terms of a Program or Membership, as applicable, will need to be either Paid in Full or will require a Down Payment with Billing payments per all Agreements.

•     Please make sure You sign out of the SIM Class at least 4 hours in advance of Your SIM Class start-time in order to allow another student to fill Your spot. The sign-out policy for is an act of good-faith and thoughtfulness for Your fellow students.

  • Students may go on hold if they are going to be out of the studio for 1 month or more and may be on hold for up to 2 months.

  • For students on a financed option, we take the payment for the first month they are on hold and then apply it for their first month back. Payments will resume their second month back per usual.

  • For students on a Paid In Full,  they will have the time on hold tacked on to the end of their membership.

  • If a student doesn’t return from hold before her two months are up, she will receive a notification from the studio that we will be activating her membership on the date that is 2 months from their hold start date. If they are on a financed option, payments will resume per usual. If on a PIF, their membership will activate after those two months and it’s up to them to schedule their new home class.

  • If for any reason we are unable to take payments upon reactivation, the membership will immediately be canceled. No credit will be given for the hold payment as it will be applied to their 30-day notice. Should the student return at a later date, she will be subject to the current pricing and membership options and will not be grandfathered into her old membership options.

  • If a student needs an extension due to a medical reason, she will be asked to submit a dr.s note.

  • Holds for pregnancies will be the exception – we will hold up to two months after the due date.

  • Students who went on hold prior to this new policy will still be allowed to be on hold for 4 months, however, their memberships will be reactivated at the end of those 4 months.

  • If a student has any other reason she needs to be on hold for more than two months, please reach out to Kerry Anne at kerryanne@sistersinmotionsf.com directly and she will do her best to work with you.

  • Should You become injured or ill to the extent that participation in a SIM Class is not advisable by Your physician, you may apply for a Medical Rollover (MRO) of Your unused SIM Classes toward a future session to be used within 4 months.

    • All Medical Roll Over’s (each, an “MRO”) will require a physician’s note. 

    • If your physician does not permit you to resume SIM Classes after the initial 4 month period, you must notify Sisters in Motion at kerryanne@sistersinmotionsf.com (or any other email address established by SIM for notices from time to time) in order to extend any credits. Failure to notify SIM within 6 hours after missing an SIM Class will forfeit the possibility of a Medical Roll Over.

Safety:  If You appear intoxicated, fail to follow SIM’s safety requirements and precautions (including without limitation, health and safety requirements and protocols established by the state or local authorities) or are otherwise disruptive to the conduct of an SIM Class or other SIM Activity, You may, at the sole discretion of Sisters in Motion, be asked not to participate, in which event You will forfeit any payments made by You for that SIM Class or other SIM Activity and shall not be entitled to receive a refund or credit. 

 

L. Arrival and Departure Times:  Please arrive a few minutes prior to Your SIM Class or SIM Activity scheduled start time.  You may depart at any time once the SIM Class or SIM Activity has started, but You cannot makeup the SIM Class or SIM Activity time should You choose to depart early. 

 

K.  Schedule Changes:  All class times, schedules and teachers are subject to change at Sisters in Motion’s discretion.

 

L. SIM Event or Performance Participation:  You hereby agree that if You attend any event of SIM Class or SIM Activity (excluding Journey SIM Classes), You agree to being photographed, filmed or taped and authorize the use of Your image by SIM for marketing purposes without compensation.

 

M. Additional Terms for Online Classes:

·       For Programs or Memberships that include online SIM Classes, Sisters in Motion agrees to hold a spot for you in the online SIM Class as agreed upon between You and SIM. Should your account become delinquent by 30 or more days for any reason, you will lose Your ability to sign into online SIM Classes without further notice, until full payment is received by SIM to bring Your account balance fully up-to-date and in good standing per the billing cycle as defined in this Agreement.

·       Every online SIM Class requires a minimum of three (3) students to be signed in twelve (12) hours in advance of the SIM Class in order for the SIM Class to be green-lit. Any online SIM Class with less than three (3) students signed in twelve (12) hours before the start time of the SIM Class is subject to cancellation by SIM, in its sole discretion.  Please be advised that a no-show/late sign-out fee will apply if you timely sign up for an SIM Class but fail to appear or join the SIM Class timely.

·       All online SIM Classes require 2  hours’ notice for students to sign out. Otherwise they may be subject to a late cancellation fee.

·       All students, including You, are responsible for updating all email and Spotify accounts in order to participate in the online SIM Class being offered.

·       Any online SIM Class may be cancelled at Sisters in Motion’s sole discretion, for any reason. In case of an online SIM Class cancellation by Sisters in Motion for which an online/virtual member has paid a per class fee, SIM will credit any payment made previously for such canceled SIM Class to another comparably priced SIM Class.  

·       Unless otherwise notified by an authorized SIM staff member in writing, the use of recording devices in or of any online SIM Class is strictly prohibited. Violation of this policy shall result in immediate termination of Student’s online access.

·       The cancellation of an online SIM Class by Sisters in Motion is not grounds, nor a permissible reason, for Agreement cancellation. 

·       Unless otherwise agreed to in writing in advance by an authorized representative of SIM, online SIM Classes provided by SIM and/or its instructors are available only to current SIM members/program holders.  Violation of this policy shall result in immediate termination of Student’s online access.

·       There will be no monetary refunds for missed SIM Classes. No exceptions.

·       Online SIM Classes are not available to students on hold.  

·       Payments are not transferrable for any reason.

·       SIM Class packages with a set date of expiration will not be extended beyond their expiration date for any reason including but not limited to injury or illness.

N. Schedule Changes:  All SIM Class and SIM Activity times, schedules and teachers are subject to change at Sisters in Motion’s sole discretion.
